Welcome to Akuchukwu Microfinance Bank Limited's Mobile Application. By downloading, using, or continuing to use the Akuchukwu Microfinance Bank Limited Mobile Application (the "App"), you confirm that you accept and agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree to these Terms, please do not use the App.

1. Bank Use

A. Services Provided

The App allows you to perform various banking services using your mobile phone, including but not limited to:

• Account Balance Retrieval
• QR Payment
• Bill Payments (subject to availability)
• Funds Transfer (both interbank and intrabank)
• Beneficiary Management
• Airtime Top-Up
• Other Services as may be added by the Bank from time to time.

B. Service Availability

Akuchukwu Microfinance Bank reserves the right to withdraw any of the listed services and does not guarantee their availability at all times.

C. Confidentiality of Login Details

Your login details are personal and confidential. You are solely responsible for protecting these details. Do not share your login details or allow third-party access to your account.

D. Security Obligations

Change your login details periodically and immediately if they become known to anyone else. Notify the Bank immediately if you suspect that your account has been compromised.

E. Reporting Compromise

If your phone, password, or mobile PIN is stolen or compromised, notify the Bank immediately. The Bank will block your account as soon as possible, but you will be responsible for transactions carried out before the account is blocked.

F. Liability for Breach

The Bank is not liable for any losses resulting from a breach of your duty to maintain the confidentiality of your login details.

G. Compliance with Guidelines

You agree to:

• Provide Accurate Information: Ensure that all information provided is true, accurate, and complete.
• Obey the Law: Do not use the App for illegal purposes or to transmit unlawful material.
• Restrict Commercial Use: Use the App for personal purposes only and do not commercialize it.
• Respect Proprietary Rights: Do not copy, reproduce, or create derivative works from the App’s content.
• Comply with Rules: Violating these rules may result in immediate discontinuation of the service.

2. Limitation of Liability

A. Unauthorized Access

The Bank is not liable for any unauthorized access to your account due to your failure to safeguard your login details.

B. Breach of Secrecy

The Bank is not liable for breaches of secrecy resulting from your failure to observe these Terms or external factors beyond the Bank’s control.

C. Damages and Losses

The Bank is not responsible for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the App.

D. Fraud and Unauthorized Access

You agree to be solely responsible for any fraud, loss, or liability arising from the use of your login details by a third party. The Bank is not liable for any fraud or loss resulting from unauthorized access to your account.

E. Indemnity

You agree to indemnify the Bank, its affiliates, and their respective directors, officers, employees, and agents from any liabilities, claims, and expenses arising from your breach of these Terms or use of the Bank’s services.

3. Intellectual Property

A. Ownership

The App is developed and maintained by Akuchukwu Microfinance Bank Limited, and all intellectual property rights belong to the Bank.

B. Restrictions

You are not permitted to copy, modify, or create derivative works from the App or its trademarks. Extracting the App’s source code is also prohibited.

C. No Transfer of Rights

Your use of the App does not transfer any rights beyond what is expressly stated in these Terms.

D. Indemnity

You indemnify the Bank against any claims, losses, or damages resulting from your use of the Bank’s intellectual property.

4. General

A. Right to Modify

The Bank reserves the right to change or discontinue the App’s services without notice, though this will not affect your obligations to the Bank.

B. Third-Party Products

The App may feature third-party products. The Bank is not responsible for the accuracy, completeness, or availability of these products and disclaims any liability arising from their use.

C. Service Availability

While we strive to keep the App available at all times, we are not liable for unavailability due to system failures, maintenance, or other reasons beyond our control.

D. Service Performance

Service performance may be affected by hardware or software issues or other events outside our control.

The Bank will not be liable for any modification or discontinuation of the App’s services.

The Bank will never request your personal or login details. Disregard any such requests.

H. Changes to Terms

5. Law and Jurisdiction

Any disputes arising from these Terms or the use of the App will be governed by the laws of Nigeria. The courts of Nigeria will have exclusive jurisdiction to resolve such disputes.
